Current Proposals
BEAVER Act of 2026
The Business Equality Against Vexatious Enforcement of Registrations Act, or BEAVER Act of 2026, is a proposed amendment to the Lanham Act intended to protect legitimate trademark rights while reducing the ability of financially powerful parties to use the cost of federal litigation as leverage against smaller businesses.
The proposal would create an expedited early review of trademark infringement claims, limit costly discovery while that review is pending, require attorney-fee awards when a claim is found to lack an objectively reasonable basis, and consider stronger evidentiary standards when competing trademarks are materially different.
The goal is not to weaken trademark protection. It is to help ensure that trademark disputes are decided on the strength of the underlying claim rather than simply on which party can afford to continue paying legal expenses the longest.
MITCH Act of 2026
The Modernizing Income and Time-Off for Caregiving and Health Act, or MITCH Act, is a proposed federal framework for national paid sick leave, paid parental leave, and paid family caregiving leave.
