Terms of Service

These Terms of Service govern technical support, consulting, troubleshooting, configuration, and related services provided by W9JAM through w9jam.com.
By purchasing, scheduling, or using a W9JAM service, you agree to these Terms of Service.
1. Services Provided
W9JAM provides technical support and consulting services that may include:
- Windows and Linux computer troubleshooting
- Software, driver, and operating system assistance
- Networking and internet connectivity troubleshooting
- Remote computer support
- Amateur radio and DMR assistance
- Radio programming and codeplug assistance
- MMDVM/WPSD hotspot configuration and troubleshooting
- APRS, networking, and related technical services
- General technical consulting and training
The specific services provided will depend on the appointment or service purchased.
2. Remote Support
Some services require temporary remote access to your computer or other supported device.
You must remain available during the session unless otherwise agreed.
Remote access will only be used for the purpose of providing the requested support. You may terminate the remote connection at any time.
Some problems cannot reasonably be diagnosed or repaired remotely. These may include failing hardware, damaged storage devices, severe operating system corruption, physical network problems, or equipment requiring hands-on testing.
If remote repair is not practical, I will explain my findings and recommend appropriate next steps when possible.
3. Customer Responsibilities
You are responsible for providing accurate information about the equipment, software, symptoms, and problem being investigated.
You must have authorization to request support for any computer, network, radio, account, or other equipment involved in the service.
You are responsible for maintaining current backups of important files and data before service begins whenever reasonably possible.
Please save open documents and close applications containing sensitive information that are not relevant to the support session.
4. Data and Backups
Reasonable care will be taken when working with your equipment and data. However, troubleshooting computers, operating systems, storage devices, firmware, software, and other electronic equipment involves some inherent risk.
Unless data backup or recovery is specifically included in the service, W9JAM does not guarantee the preservation or recovery of data.
Customers are strongly encouraged to maintain current backups before troubleshooting, repair, software installation, operating system changes, firmware updates, or other technical work is performed.
5. No Guaranteed Repair
Payment is for the professional time, knowledge, diagnostics, troubleshooting, configuration, and assistance provided.
W9JAM cannot guarantee that every technical problem can be repaired or resolved.
Some issues may ultimately require replacement hardware, manufacturer service, software reinstallation, data recovery, an internet service provider, another specialist, or in-person repair.
An inability to completely resolve an issue does not by itself mean that services were not provided.
6. Appointment Time
Your appointment includes the amount of support time selected when booking.
If it appears that additional time will be required, you will be informed before the scheduled appointment time is exceeded.
Additional time may be offered at a discounted extended-support rate.
No additional billable support time will be added without your approval.
7. Payments
Payment may be required when scheduling or purchasing a service.
Prices and included service time will be displayed at the time of purchase or booking.
Any additional services or charges must be approved before they are added.
8. Cancellations and Refunds
Appointment cancellations, missed appointments, rescheduling, and refunds are governed by the separate Cancellation Policy and Refund Policy published on w9jam.com.
Those policies are incorporated into these Terms of Service.
9. Radio Programming and Regulatory Compliance
W9JAM may assist with programming, configuration, and troubleshooting of amateur radio, DMR, NXDN, APRS, hotspots, and related equipment.
The customer remains responsible for operating equipment legally and in accordance with applicable FCC regulations, license privileges, frequency restrictions, repeater policies, network rules, and other applicable requirements.
Programming assistance does not constitute authorization to transmit on any particular frequency, system, network, or service.
10. Third-Party Products and Services
Technical support may involve products or services provided by third parties, including operating systems, software developers, equipment manufacturers, internet providers, radio networks, hosting providers, or cloud services.
W9JAM does not control these third-party products or services and cannot guarantee their availability, reliability, policies, compatibility, or future operation.
Changes made by a manufacturer or third-party provider may affect previously working configurations.
11. Passwords and Account Access
In some cases, troubleshooting may require you to sign in to an account, provide administrative authorization, or enter a password.
Whenever practical, you should enter passwords yourself rather than providing them directly.
W9JAM will not request passwords or credentials that are not reasonably necessary to perform the requested service.
12. Software and Licensing
Customers are responsible for maintaining valid licenses for software installed or used on their equipment.
W9JAM will not knowingly install pirated, cracked, illegally obtained, or improperly licensed software.
Any software installed during a support session remains subject to the license terms of its developer or publisher.
13. Security and Malware
Reasonable efforts may be made to identify and correct malware, security problems, or unsafe system configurations when included in the requested service.
No computer, network, or security configuration can be guaranteed to remain completely secure.
W9JAM does not guarantee protection against future malware infections, security vulnerabilities, account compromises, data breaches, or other cybersecurity incidents after service has been completed.
14. Limitation of Liability
To the extent permitted by applicable law, W9JAM is not responsible for indirect, incidental, or consequential losses resulting from equipment failure, data loss, third-party service failure, software defects, manufacturer defects, or circumstances outside of reasonable control.
Nothing in these Terms is intended to exclude rights or protections that cannot legally be waived.
15. Appropriate Use of Services
W9JAM services may not be used to assist with illegal activity, unauthorized access to systems or accounts, circumvention of legitimate security controls, piracy, harassment, or other unlawful conduct.
Service may be refused or terminated if a request appears illegal, unsafe, fraudulent, abusive, or outside the reasonable scope of the service purchased.
16. Privacy
Information collected while scheduling or providing services is handled according to the separate W9JAM Privacy Policy available on w9jam.com.
Only information reasonably necessary to provide, manage, document, and support the requested service should be collected or retained.
17. Changes to These Terms
These Terms of Service may be updated periodically as services, technology, payment systems, or business practices change.
The current version and effective date will be published on w9jam.com.
Terms applicable to a service are generally those in effect when the service is purchased or scheduled, unless a change is required by law.
